Cet article se donne pour tâche l’examen de la fécondité conceptuelle d’une réduction paradigmatique souvent effectuée par les études en phénoménologie contemporaines de la danse : la réduction du mouvement dansé aux _kinesthèses_ par lesquelles il devrait être immédiatement vécu. Nous entendrons montrer, au contraire, que les kinesthèses ne permettent pas de rendre compte du mouvement vécu parce qu’elles le transforment en un vécu de mouvement demeurant extérieur au sujet qui le vit. Cette critique nous amènera ensuite à repenser conjointement (...) le mouvement dansé comme véritable sujet de la danse et le corps dansant comme déposé par ce mouvement en lequel il est pris. Les investigations phénoménologiques de Patočka ne prennent leur sens que si elles sont rattachées à un dilemme coextensif à la phénoménologie elle-même. Il est en effet possible d’affirmer que la phénoménologie trouve son sens originaire dans une révolte contre l’univocité de l’être, et ceci dès sa fondation par Husserl. Cet article tente d’utiliser la méthode phénoménologique afin de proposer une description de la nausée à partir d’une perspective dynamique, à rebours des analyses traditionnelles fondées sur la contingence. Il s’agit de voir que la nausée doit être pensée à partir d’une distinction entre motricité et mobilité subjectives résultant d’une transformation de la motion en locomotion. Étant en mouvement sans se mouvoir, le sujet y est susceptible de saisir en même temps le monde extérieur et l’habitacle de son véhicule comme (...) le sol immobile sur fond duquel seulement sa mobilité sera possible. La nausée sera alors l’expérience de la perte de notre appartenance par sa propre démultiplication. (shrink)

Medical research involving human subjects raises complex ethical, legal and social issues. Investigators sometimes find that their obligations with respect to a research project come into conflict with their obligations to individual patients. The ethical conduct of research rests on 3 guiding principles: respect for persons, beneficience, and justice. Respect for persons underlies the duty to obtain informed consent from study participants. Beneficence demands a favourable balance between the potential benefits and harms of participation. Justice requires that vulnerable people not (...) be exploited and that eligible candidates who may benefit from participation not be excluded without good cause. Studies must be designed in a way that ensures the validity of findings and must address questions of sufficient importance to justify the risks of participation. In any clinical trial there must be genuine uncertainty as to which treatment arm offers the most benefit, and placebo controls should not be used if effective standard therapies exist. Researchers have a responsibility to inform themselves about the ethical, legal and policy standards that govern their activities. When difficulties arise, they should consult the existing literature and seek the advice of experts in research ethics. (shrink)

In his article 'Specifying, balancing and interpreting bioethical principles' (Richardson, 2000), Henry Richardson claims that the two dominant theories in bioethics - principlism, put forward by Beauchamp and Childress in Principles of Bioethics , and common morality, put forward by Gert, Culver and Clouser in Bioethics: A Return to Fundamentals - are deficient because they employ balancing rather than specification to resolve disputes between principles or rules. We show that, contrary to Richardson's claim, the major problem with principlism, either the (...) original version, or the specified principlism of Richardson, is that it conceives of morality as being composed of free-standing principles, rather than as common morality conceives it, as being a complete public system, composed of rules, ideals, morally relevant features, and a procedure for determining when a rule can be justifiably violated. Ce graffiti exprime à sa manière l'un des grands défis de la philosophie française de cette fin de siècle, à savoir celui de sa popularité. Car la philosophie est désormais au centre de la vie publique : elle trône dans les cafés, se fait une place dans l'entreprise et s'installe même dans (...) les cabinets privés. Demands by Patients or their Families for treatment thought to be inappropriate by health care providers constitute an important set of moral problems in clinical practice. A variety of approaches to such cases have been described in the literature, including medical futility, standard of care and negotiation. Medical futility fails because it confounds morally distinct cases: demand for an ineffective treatment and demand for an effective treatment that supports a controversial end (e.g., permanent unconsciousness). Medical futility is not necessary in (...) the first case and is harmful in the second. Ineffective treatment falls outside the standard of care, and thus health care workers have no obligation to provide it. Demands for treatment that supports controversial ends are difficult cases best addressed through open communication, negotiation and the use of conflict-resolution techniques. Institutions should ensure that fair and unambiguous procedures for dealing with such cases are laid out in policy statements. (shrink)
